U.S. Supreme Court: Barnes v. Felix
Mr. Fomby served as lead counsel for the family of Ashtian Barnes in Barnes v. Felix, a landmark civil rights case arising from a fatal police shooting during a Houston traffic stop. He argued the case in the U.S. District Court for the Southern District of Texas and in the Fifth Circuit, and at the Supreme Court he partnered with former Acting Solicitor General Neal Katyal. On May 15, 2025, the Supreme Court ruled unanimously, 9–0, in his client’s favor, rejecting the “moment of threat” doctrine and holding that courts must judge police use of force by the totality of the circumstances. The decision now governs excessive-force cases in every federal court in the country. Read more about the case.
Mr. Fomby’s doggedness and tenacity in the courtroom have earned him a reputation in the legal community throughout the State of Texas as a lawyer who will fight tooth and nail to get the result his clients deserve. His cases are routinely featured in news and media outlets, and he is often noted for winning the “unwinnable” argument in hearings and at trial, largely because of his relentless work ethic and desire to win for his clients.
Mr. Fomby has been selected to Texas Super Lawyers since 2025, after being named a Super Lawyers Rising Star every year from 2019 to 2024. He is also a Fellow of the Texas Bar Foundation. Each year, one-third of one percent of Texas attorneys are invited to become Fellows of the Texas Bar Foundation, and election to the Fellows is one of the highest honors that can be bestowed upon a member of the State Bar of Texas.
Mr. Fomby graduated from the University of Texas at Austin with a degree in Economics, and attended law school at the University of Houston Law Center, where he served as Managing Editor of the Energy and Environmental Law and Policy Journal.
Outside of work, Adam enjoys spending time with his wife and daughter, skiing, traveling the world, and trying new foods and restaurants.
